Is there anything I can do?
 
This has nothing to do with sex or anything like that.

I am a bit pissed off (sorry, scuse my french). As silly as it may sound, its bugging me.

I got a nokia 8310 mobile phone from my boyfriend who had taken out a contract and got the phone for free. He also paid for the insurance.

At work two weeks ago, (not allowed to carry mobile phones on me at work) I had left it on a table, at the far end of the room. When I returned, the phone had been taken and switched off.

After looking for it and asking people, the supervisor contacted the police who later came to take a statement.

When I got home, my boyfriend phoned the network provider and the insurance company to alert them as to what had happened. They proceeded to block the phone so that no one could use it, even with another sim card.

A claim form was sent to my bf, which was filled out and sent back alone with the £50 excess cheque.

2 days later, he recieved a letter saying that the claim had be rejected as the phone was not meant to be left unattended.

John went to the bank to cancel the cheque but it had already been cashed!!!!!

What can I do? i feel so screwed over!

Write to the insurance company with a copy of their claim rejection letter with details of your cheque which they cahed, and ask for it to be repaid immediately. If you are feeling arsey about their behaviour find the details of the insurance ombudsman and copy them in on your letter.

If they cashed the check which was meant for that purpose, they can get into some serious trouble for then rejecting you. I -think-. It's check fraus, technically. I -think-.

John is going to phone them, when he gets his finger out... Shout at them a bit.

But its been long enough, I wont hold my breath waiting for him to call. I cant even do it myself because it wasnt in my name :(

Calling on behalf of your fellow, as a courtesy of course, prior to taking

the matter to the police for theft and the papers for mega publicity.

It's an option.
